Rule 36
Not being a viable candidate for promotion

(1) Notwithstanding anything contained elsewhere in these Rules, a military person shall not be a potential candidate for promotion during the following periods and conditions:-
(a) For suspension during the period of suspension,
(b) During the period of suspension for suspension of promotion,
(c) For one year from the date of reduction to a lower post,
(d) In case of receipt of notice, up to one year from the date of receipt of notice,
(e) in respect of any offense under investigation by the Court of Inquiry or by the Committee under Section 62 of the Act, or unless cleared by the Court in the case of a case being filed,
(f) In the case of an officer working abroad on special appointment, throughout the period mentioned in the contract signed by him,
(g) Staying abroad for study or training in private endeavors throughout the period mentioned in the contract,
(h) If judged by the court to have committed an act that violates human rights and humanitarian law,
(i) Health Classification MEDDICISIOS (if more than two in G,
(j) In case of criminal offenses like financial irregularities and polygamy,
(k) In the case of conviction of other offenses by the court, till the sentence is paid,
(l) If he has received excessive punishment once for any offense by a military court
(d) In case of failure to command a formation, unit or unit of the Nepali Army and is removed,
(d) b. M. i. Test and b. F. T. (2) Notwithstanding anything written in clause (j) of sub-rule (1), during the health examination of a military person who has suffered a physical injury while performing military training or performing his duties, he remains physically and mentally healthy except for the injured part. If he is able to complete the required training, the medical board can provide him with health classification MEDDICISOS (G A) and thus there will be no hindrance in the appointment of military personnel who have been given health classification MEDDISICSOS (G A).
